No charges for other officers on scene of police killing in Ohio

A grand jury decided on Friday not to charge two University of Cincinnati police officers who witnessed the immediate aftermath of a fellow officer fatally shooting a black man during a traffic stop on July 19.

At least one of those officers -- Phillip Kidd -- allegedly lied in an initial incident report about what he saw leading up to the shooting.

Ultimately, both officers told the truth in sworn statements, according to the Hamilton County Prosecutor's office.

Former University of Cincinnati police officer Ray Tensing shot and killed Samuel Dubose after he pulled Dubose over for driving a car without a front license plate. He has been charged with murder and second-degree manslaughter, and was fired. He is free on bond.

Tensing said he was dragged by Dubose's car and had to shoot to save his life. The body camera footage, released Wednesday and shown below, tells a different story.

Kidd claimed to see the car drag Tensing according to an incident report following the shooting.

Kidd's officer in training, David Lindenschmidt, was also at the scene, though Kidd said it was unclear how much Lindenschmidt had seen.

That said, an analysis by The Guardian of body camera footage following the shooting shows two officers repeat Tensing's account of what happened three separate times.

Neither Kidd nor Lindenschmidt will be charged.

Hamilton County Prosecutor Joseph Deters -- who called the shooting "one of the most heinous acts I have ever seen" -- said he "fully" agrees with the decision not to charge the other officers.

He said there had been "confusion" surrounding the initial statements of officers after the shooting, but that neither of them had filed a sworn statement contradicting what actually happened.
